The terms and conditions stated here relate to the supply of goods from The Cue Store Limited to ‘you’ (The Customer). By ticking the ‘I Agree box’ you are agreeing to the said terms and conditions set out here.

If you do not accept any of these terms and conditions, please do not continue through checkout.

You are also agreeing that you are either over 18 Years of age or that you are accessing this site and using it with parental consent or with the help of a guardian or similar. By completing and submitting an electronic order via our website, you are making an offer to purchase goods. Once payment has been authorised and accepted by The Cue Store Limited you will be deemed to have accepted our terms and conditions of sale.

The Cue Store Limited require that full payment is made before your order can be accepted. Please note orders will only be completed and dispatched once we have confirmation of authorisation from your payment card issuer.

We will not be liable if there is any delay in this process and we cannot accept your order if payment from the card issuer is refused or is not authorised.

Confirmation of orders will be responded to with a confirmation email to the email address used in the form supplied. This email is only confirmation that your order has been received and this does not constitute acceptance from us.

The Cue Store Limited reserve the right to refuse any order and are not obliged to give reason. We reserve the right to change any price or product without notice.

Pricing and Availability

All information on our website is regularly maintained and we make every effort to ensure this is correct and up-to-date. We cannot be held liable for mistakes or omissions.

All goods are offered subject to availability. In the event of a product not being available we will inform you and where possible suggest an alternative option.

The Cue Store Limited reserve the right to amend prices on products at any time.

Products listed at Promotional prices, i.e., a Sale Price, a Seasonal Offer or a Package deal would have been on offer individually at the full price in our showroom for at least three months prior to any advertised offer. Elite 8 Ball Lounge members discounts may not be applied to items that already carry a promotion on our website, and will only apply to those items being sold with no promotion or special offer on them.

All prices on the the Cue Store website are in GB Pounds and payment can only be accepted in this format. Orders over £75 are inclusive of mainland UK carrier delivery. NB. carriage charges apply for orders below this value and will be quoted at checkout.

For outlying areas where carriage costs are higher, we may need to ask for a contribution to these additional costs if this cost is not agreed then we reserve the right to cancel the order and will provide a full refund to your card.

At present we do not accept orders from outside the UK

Products

All dimensions, weights, balance points etc quoted on the website are approximate and a variation of +/- 10% should be allowed for when making a purchase

Delivery

Standard delivery will be approx. 3-5 days from order, next day delivery may be available at an extra charge on request.

When goods cannot be dispatched within our normal time frames, we will contact you. At this point you can either agree to the delayed delivery or choose an alternative. If neither is acceptable, we will provide a full refund to your card.

We cannot be held liable for late deliveries caused by circumstances outside of our control, such as third-party delays and adverse weather.

Goods will be delivered to the address specified in the order process.

The Cue Store cannot be held responsible for any failed delivery due to incorrect information during processing the order by you. If you are not in when the goods are delivered you need to follow the instructions provided by the carrier, please note

you will be liable for additional carriage costs resulting from multiple failed attempts to deliver.

If upon receipt goods are found to be damaged you should inform us immediately by e mail to thecuestore@outlook.com.

You should take photographs of any damaged packaging prior to opening, keep any delivery notes or other details supplied with the goods for your and our records.

It is your responsibility to confirm that what you sign for is what is delivered, mistakes cannot be rectified afterwards.

Any discrepancies or damaged packaging must be noted on the delivery note and it will be your responsibility to notify us via thecuestore@outlook.com within 2 working days from delivery.

You are deemed as the owner of any such goods you have paid for once the goods are dispatched. Any transit damage to the goods, shortages or incorrect goods should be conveyed to us as soon as possible after delivery. From the time of receipted delivery of the goods, any loss or damage to the goods shall be at your own risk.

Returns

We have a 14 day returns policy. You will need to notify us within this time frame and then return the goods to us ensuring that they are returned unopened and as new. When returning you must also attach and include full documentation containing your personal details and your original order number so that the goods can be tracked on their return. All returned goods must be sent by the buyer and be via insured carrier for your own protection and be in the original packaging. You are responsible for the goods until they are returned. Goods found returned in a lesser format will be liable to a charge should any damage then ensue due to poor or shoddy packaging or other damage directly resulting from the method or means used to return said goods.

All goods should be returned directly first hand via a courier and not left for collection where they can be exposed to the elements from water damage, frost,

cold, heat or similar. Goods that have been custom made or personalised for you are non-returnable.

Under no circumstances should goods be returned until we have authorised it and have given instruction on how and where items should be sent. Any failure to follow this procedure may result in additional costs to you.

Returning goods that are faulty to receive a full refund must be returned in their original packaging and in the same condition in which they were received and again must be returned by insured carrier. If you wish to return goods you have a duty to keep them in your possession and to take reasonable care of them until you return them. Please note that our returns policy does not affect your consumer statutory rights.

The Cue Store Limited may at its discretion agree to accept the return for credit of unwanted products, the goods must be returned following agreement in writing from The Cue Store Limited within 14 days of delivery. The goods must be unopened and in perfect re-saleable condition. If any items are missing in the original sale we will deduct the costs from the refund due. All goods returned in these circumstances (except where the Consumer Protection (Distance Selling) Regulations 2000 apply) will be subject to a 15% administration and re-stocking fee of the original sales value.

Used goods are non-returnable, goods damaged via wear and tear are non-returnable

You will need to allow 3 weeks for returns to be processed.

Cancellations

Stocked Items, the product needs to be cancelled before the item has been dispatched. NB Orders need to be cancelled in writing by e mailing thecuestore@outlook.com.

Non-Stocked or Special-order items can only be cancelled if we are in time to cancel with the supplier, any costs passed onto us by our suppliers for order cancellations will be taken from your original payment amount prior to any refund being made.

Orders for Custom Made products may not be cancelled once manufacture has started

Should the product have already been dispatched then you will be responsible for the costs of the delivery and return costs of the product.

If an order has been dispatched and delivered you need to return the goods within seven days and in new condition. Once we receive the product, we will then process your refund less any delivery and or return charges we incur.

Any ensuing damage caused in return will be deducted from the value of the goods so it is compulsory that you use a courier with an insured service so you can make a claim with them later if need be.

Damaged Goods

All goods that arrive as damaged must be reported to us within 48 hours of them being received. Failure to report and provide evidence of such damaged goods will invalidate your claim for goods received as damaged. Only with our written consent may they be returned and only after our written instructions on the said procedure that the customer will be advise to follow dependent on the type of goods ordered.

General

The Cue Store Limited will not be liable to you for any indirect or consequential loss or damage arising out of any problem relating to goods delivered to you and shall have no liability to pay any compensation other than to refund you the amount paid for the goods upon their return. Please note that nothing contained herein limits any rights you have as a consumer under the laws of England and Wales. Nothing in these terms and conditions creates any right which is enforceable by any person who is not a party to the contract between you and The Cue Store Limited. The Cue Store Limited shall have no liability to you for any failure to deliver the goods you have ordered or for any delay, damage or defect to goods delivered caused by circumstances beyond its reasonable control. If any part of these conditions is unenforceable, the enforceability of any other part of these conditions will not be affected.

We are happy to give any information or advice that any prospective customer may need before making a purchase.

Confidentiality

We do not sell information or disclose any of your data to third parties. Any confidential information supplied by you in the form of credit card details, or similar, will be processed securely by a dedicated third party. Any details are held securely by them for the sake of processing orders and are transmitted in encrypted form.
